1. Introduction
Welcome to NeutralServiceGrove ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at neutralservicegrove.sbs (the "Service") operated by NeutralServiceGrove.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
NeutralServiceGrove offers top-tier yacht charter services, which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Services are available based on current conditions and we retain the authority to adjust or discontinue our services at our discretion.
3. Booking and Reservations
3.1 Booking Process
For charter reservations, you must:
- Be at least 18 years of age
- Provide valid and complete details
- Pay the specified deposit as noted in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A confirmation of your booking only becomes official once payment is received and you receive our written confirmation. We hold the right to decline services at our sole discretion.
3.3 Availability
Charter availability is contingent on vessel schedules and favorable weather conditions. We will endeavor to meet your requested dates and timings.
4. Payment Terms
4.1 Pricing
All rates are provided in € and include taxes unless stated otherwise. Pricing is liable to alterations without prior notification.
4.2 Payment Schedule
- Deposit: Half of the total charter fee is due upon booking
- Balance: Payable 48 hours prior to the charter's departure
- Any additional costs (if applicable): Payable following the conclusion of the charter
4.3 Payment Methods
We accept most major credit cards, direct bank transfers, and certified cheques. All payments are processed through secure and encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours in advance of departure: Entire refund minus any processing charges
- Between 24 and 72 hours before departure: Half refund
- Less than 24 hours in advance of departure: No refund will be issued
5.2 Weather Cancellations
Should our captain determine the weather to be unsafe, we will propose to:
- Reschedule the charter to another available day at no extra fee
- Issue a full refund if a reschedule is not feasible
5.3 Mechanical Issues
If there are mechanical issues with the vessel meant for your charter, we'll seek to offer a suitable replacement. If no alternative vessel is available, you will be issued a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Passengers have to:
- Adhere to all instructions given by the crew
- Utilize the provided safety gear when instructed
- Inform us of any health conditions that could impact their safety
- Stay within the assigned areas on the vessel
6.2 Prohibited Items
Certain items are prohibited on the vessel:
- Glass containers
- Illegal substances
- Weapons of any kind
- Excessive quantities of beverages (beyond moderate consumption)
- Pets (unless given prior approval)
6.3 Conduct
Passengers are expected to behave in a courteous manner. Should passenger actions create a safety hazard or interrupt the enjoyment of others on the charter, we may end the charter early without refund.
7. Liability and Insurance
7.1 Our Liability
Liability on our part is confined to the fee paid for your charter. We cannot be held accountable for:
- Personal harm due to passenger carelessness
- Theft or destruction of personal belongings
- Indirect or exemplary damages
- Delays caused by elements beyond our controlling capacity
7.2 Insurance Coverage
We maintain comprehensive maritime insurance for our fleet and operations. You are responsible for your own travel and personal insurance coverages.
7.3 Assumption of Risk
Your participation in our charter services signifies acknowledgment of the inherent risks associated with water activities and acceptance of responsibility for your personal safety and security.
8. Modifications and Itinerary Changes
We retain the right to amend itineraries, routes, or schedules due to weather considerations, safety reasons, or operational demands. Efforts will be made to provide an equivalent alternative experience.
9. Force Majeure
We cannot be deemed responsible for hold-ups, cancellations, or modifications due to conditions outside our control, including but not restricted to:
- Extreme weather conditions
- Natural catastrophes
- Governmental orders
- Closures of ports
- Mechanical breakdowns
10. Privacy and Data Protection
Your privacy is managed in line with our Privacy Policy. By engaging with our services, you agree to the data collection and use as outlined in our Privacy Policy.
11. Intellectual Property
All content present on our website, ranging from text and graphics to logos and images, is sheltered by copyright and trademark laws. Copying, distributing, or producing derivative works is not allowed without our expressed permission.
12. Governing Law
The regulations governing these Terms are the laws in force in Monaco. Any disputes will be processed in the courts located in Monaco, Monaco.
13. Changes to Terms
We reserve the authority to update these Terms at any given time. Any revisions will be published on our site with a revised date of effect. Usage of our services post revision signifies an agreement to the updated terms.
